These Terms and Conditions shall be used by:

Article 1 Definitions

In these Terms and Conditions, words used in singular or plural, starting with a capital letter, have the meaning of the obliquely printed words as defined below in this article.

1.1 Terms and Conditions: these general terms and conditions.

1.2 Ordering Procedure: the procedure, Customer goes through interactively on the website, to order business.

1.3 Customer: The other party of HappyDutchCheese with whom HappyDutchCheese enters into an agreement.

1.4 Agreement: Agreement, in which the Terms and Conditions are an integral part, concerning the purchase and supply of business.

1.5 Parties: HappyDutchCheese and customer together.

1.6 HappyDutchCheese: the party that operates general terms and conditions, also the other party of Customer.

1.7 Website: HappyDutchCheese website, wich can be found under the URL http://www.Happydutchcheese.com

1.8 Business: Location where cutomers can order from the website, http://www.happydutchcheese.com  
 

Article 2 Applicability

2.1 The Terms and Conditions apply to all agreements, any (e-mail) newsletters, the website, the order procedure as well as contacts and/or (legal) acts between the parties, even if these (legal) acts were not allowed to lead to an agreement.

2.2 Applicability of general delivery or payment terms and/or other general or special terms of customer is expressly excluded.
 

Article 3 Conclusion of Agreement

3.1 The Business offered on the Website with associated prices is a non-binding offer, which can be accepted by the customer by going through and completing the entire ordering process.

3.2 HappyDutchCheese does not guarantee that the offer is without errors and/or omissions. Printing and printing errors are therefore expressly reserved and may be grounds for not trying to make the agreement stand. If HappyDutchCheese decides to do so, it will inform customers without delay.

3.3 If, for any reason, including the situation as referred to as the last sentence of the previous paragraph, the agreement has not been concluded or has been terminated, HappyDutchCheese shall ensure that – if the customer has paid in advance – the amounts paid, including the initial shipping costs, are refunded to customer as soon as possible from HappyDutchCheese. This refund is in any case within 30 days.  

 

Article 4 Prices and Payment

4.1 Prices listed on the Website exclude VAT, as well as other state-imposed charges. Prices do not include shipping costs. This will be charged to customers during the order process.

4.2 HappyDutchCheese is entitled to adjust prices at all times. The latter has no effect on current agreements which will be implemented at the agreed prices in the case of price increases.

4.3 By Customer, the amounts due can be paid by payment service provider (PSP):

a. By creditcard
b. By Pay Pal

 

Article 5 Delivery Period

5.1 Delivery times are normally six (6) days after shipment. We ship once a week. All orders are prepared on Monday and picked up on Tuesday by tranporter. If a product needs to be ordered, we try to use a delivery time of seven (7) days.

5.2 HappyDutchCheese will make every effort to achieve the indicated delivery times.

5.3 If and to the extent that HappyDutchCheese cannot deliver the ordered Business to Customer within 30 (30) days, the Customer shall have the right, after HappyDutchCheese has indicated that he cannot execute the Agreement within the specified time limit, to cancel the Agreement. Article 3.3 shall then apply mutandis.  
 

Article 6 Right of Withdraw

6.1 The customer has the right to return items to HappyDutchCheese within seven (7) working days of receipt, without giving reasons (i.e. without having to complete the complaint form referred to in Article 7.1) provided that:

a. the items are in the original and unopened packaging and have not been used;
b. The items are returned at the customer's expense, inadequately stamped packages are not received by HappyDutchCheese;
c. the customer is responsible for the method of adjustment and for the risk of the package – this responsibility and this risk will be accepted by customer – until HappyDutchCheese has received it.

6.2 The revocation is a rescinding condition whereby the customer is entitled to a refund of what has already been paid. Article 3.3 shall apply in the case of withdrawal of corresponding.

 

Article 7 Advertising

7.1 If, in the opinion of the customer, the characteristics of the business do not comply with the agreement, then the customer shall enter into consultation with HappyDutchCheese. The customer is entitled to return the Business to HappyDutchCheese provided that:

a. The customer immediately inspected the delivered package upon receipt and made any defects to HappyDutchCheese apparent in writing within a competent time;
b. tThe complaint form, included in the delivered package or downloaded from the website, has been completed in full; 
c. The items are returned at the customer's expense, inadequately stamped packages will not be accepted by HappyDutchCheese;
d. the Customer is responsible for the method of adjustment and for the risk of the package – this responsibility and this risk are accepted by customer – until HappyDutchCheese has received it.

7.2 If, after examination by HappyDutchCheese it appears that the properties of the business do comply with the agreement, HappyDutchCheese will enter into consultation with customer.

7.3 If, after examination by HappyDutchCheese, it is indeed apparent that the characteristics of the business do not comply with the agreement, the customer is entitled to a replacement case, provided that it is still available, and refund of the postage costs referred to in point 7.1. If the replacement case is not available, the customer is entitled to:

a. The sorting out of a replacement case worth case which was found not to be answered, if the chosen case is more expensive than the case which was not found to be answerable, then the customer shall explain the difference in price if the chosen case is cheaper than the case which was not found to be answerable. The Customer will get the difference in price back, with the last sentence of Article 3.3 being applicable accordingly;
b. the value of the case refund which shall be the (partial) dissolution of the agreement to which the last sentence of Article 3.3 applies mutandis.

7.4 Where the preceding paragraph refers to the value of the case, the price agreed in the Agreement shall be referred to.

7.5 During the period referred to in Article 6.1, the customer may also benefit from the right granted in that article. However, with a completed complaint form, the procedure as in this article is assumed.


Article 8 Processing of Personal Data

8.1 If and to the extent that personal data is processed for the customer, thie processing applies only to:

a. to be able to implement and implement the agreement;
b. subject to the restriction of the following member, to inform the customer of (new) products and services of HappyDutchCheese.

8.2 For the purpose of sending commercial expressions by electronic means to customers (e.g., but not exclusively e-mail newsletters) as referred to in previous paragraph under b, the customer is expressly requested permission during the order procedure, and only if this consent has been granted by the customer will HappyDutchCheese send these expressions.

8.3 The customer is at all times entitled to obtain access to his personal data free of charge and to adjust this data, if desired, by HappyDutchCheese in case of inaccuracies.  

 

Article 9 Applicable Law, Complaints and Disputes

9.1 Dutch law applies to the agreement and further agreements resulting thereof.

9.2 If and in so far as there is a complaint, customer will contact HappyDutchCheese, which can be contacted by telephone, in writing and electronically. The contact information that can be used for this purpose is listed at the top of these Terms and Conditions. HappyDutchCheese will respond to a complaint as intended within 30 days at the latest.

9.3 Customer may submit the dispute to a competent court in 's-Hertogenbosch, including the Court of Appeal, which is not legal in summary proceedings if and to the extent that the parties do not come forward.

 

Article 10 Other Provisions

10.1 HappyDutchCheese is at all times authorized to amend these Terms and Conditions. Current agreements will be honored under the old agreed terms and conditions after amendment of the Terms and Conditions.

10.2 If and to the extent that HappyDutchCheese has provided login details for the ordering procedure, customer will take care of this information himself. This information is strictly personal and may not be transferred under any circumstances.

10.3 The Customer is responsible for the consequences of careless handling of this data.
